Rajakannappan Joined in ADMK

Rajakannappan joined in ADMK along with his men today.Rajakannappan who resigned himself from DMK as a basic party member and as an MLA, decided to join in ADMK after discussing with his party members in chennai. Accordingly yesterday evening they went to ADMK chief secretary and party lead Selvi Jeyalalitha's residence in Poes garden , chennai. There the party members reunited themselves into ADMK again infront of Jeyalalitha.

Related to this the party news quoted that : R.S.Rajakannanppan who was elected as an MLA ,from Ilayangudi Assembly, besides DMK reunited him and his party members in ADMK this evening. Other members who joined were Anitha Simon from sivaganga, Lakshmi Rathnam from Ilayangudi, Sabiulla, Chandra Dinakaran from paramakudi, Veerapathran from Mandapam, V.C.Gopi from Thiruppuvanam and so on. Members who joined in ADMK said they will participate along with the other ADMKities in the upcoming Parliament election and Assembly elections.

BSNL 3G Services

BSNL launches 3G services
BSNL, Bharat Sanchar Nigam Limited the country's Telephone Network announced on Friday that it had launched the 3G Third Generation mobile services in India in eleven cities. Also it is planning to expand this facility to other places in India. Stating that BSNL invested around Rs27K crore amounting to $530 million for 3G Infrastructure and this will cover major cities and towns in the nation.

Interestingly India will be holding an auction for this 3G spectrum in the later part of this year. Moreover the sectors individual units in states were given slots each in their respective service area having to compete or match the bid of the private operators in this market field.

3G is the next generation of mobile communications systems. It enhances the services such as multimedia, high speed mobile broadband, internet access with the ability to view video footage on your mobile handset. With a 3G phone and access to the 3G network you can make video calls, watch live TV, access the high speed internet, receive emails and download music tracks, as well as the usual voice call and messaging services found on a mobile phone, like person to person video, live streaming, downloadable video of entertainment, news, current affairs and sport content and video messaging.Contents available in 3G services include Mobile TV, Mobile Broadband, Video calls, Movies, Video PRBT etc.

USIM is a SIM card for 3G services. USIM stand for Universal Subscriber Identification Module. USIM is provided to access 3G services. The storage capacity of 3G SIM will be 128 KB ie 128 KiloBytes or 1024 bits.

Hike in DA for Central Government Employees

Today, The Union Cabinet increased the DA, Dearness Allowance for the employees of Central Government Sectors. This hike amounts to 6% adding to the existing DA of 16%.Hence the effective DA will become 22% and this hike comes into effect from January, 1 2009. Bu this will increase the burden of the exchequers that would amount to cross Rs 6K crores.

Recently the India's stand in Finance Minister Pranab Mukerjee had announced the tremendous cuts like 2% cut in service Tax and excise duties. This would cost around Rs 29K crores that the government has to bear upon. But the cut of in central excise duties of 4% would continue to next year also while the excise rates of 10 % would be cut by 2%.

Simple application forms in easy language will be available at D.F.S.C./ D.F.S.O./A.F.S.O. / I.F.S. office for being filled by the applicants for Ration Cards (PassPort size Photographs may be required to be affixed if so required in the Application Form). Special arrangements are made at District Office to help the applicants to fill up the forms and to explain the procedure followed before Ration Cards are issued in their favor.

Every application for Ration Card will be duly acknowledged on the spot and given a suitable Registration Number.The acknowledgment slip will indicate the date on which the Ration Card can be collected in case all information as required have been correctly given and it has been possible for the authorities to do the re4quired verification and complete the various formalities.

In case the Ration Card is not ready for collection on the date as specified in the acknowledgment slip, the reasons for the delay and the likely date by which the card will be available will also be invariably intimated.

All Ration Card holders will be suitably advised and given appropriate guidance regarding the FPS at which they could register their cards for obtaining supplies. Any difficulty faced by the cardholders in this regard will be resolved within two days by deputing appropriate inspecting officials to the FPS under intimation to the cardholder.

All staff and officials having public contact in connection with the issue of Ration Cards will wear name badges and will attend to the needs of the public courteously and promptly.

In General , KVA = 1000 Watts. But practically there is some deviation or difference in power factors for KVA and KW, if you discuss this for AC against DC. But this will not deviate and no concern to anyone.

But Watts represents the Power.When coming to the theoretical explanation, W represents the power consumed actually, whereas VA represents the potential power. The electricity consumed by the appliances when it is running is interpreted as W.

Income Tax Exemption For Physically Disabled

Section 80E
Under this section, deduction is available for payment of interest on a loan taken for higher education from any financial institution or an approved charitable institution. The loan should be taken for either pursuing a full-time graduate or post-graduate course in engineering, medicine or management, or a post-graduate course in applied science or pure science.

The deduction is available for the first year when the interest is paid and for the subsequent seven years. Up to March 2005, deduction was available for the repayment of principal and interest aggregating to Rs 40,000 a year.

Section 80U
It is deduction in the case of a person with a disability. An individual who is suffering from a permanent disability or mental retardation as specified in the persons with disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 or the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999, shall be allowed a deduction of Rs 50,000. In case of severe disability it is Rs. 75,000.

The assessee should furnish a certificate from a medical board constituted by either the Central or the State Government, along with the return of income for the year for which the deduction is claimed.

A person who is suffering from permanent physical disability or mental retardation is entitled to deduction upto Rs. 40,000.

Handicapped must be certified by a physician, surgeon or a psychiatrist, working in a government hospital.

Under section 80DD and 80U of Income Tax Act, physical disability must be one of the following:

1. Permanent or more than 50% disability in limb
2. Permanent or more than 60% disability in 2 or more limb
3. Permanent loss of voice
4. Permanent blindness
5. Mental Retardation in which mental intelligence is less than 50% of normal required intelligence

Railway Budget

Railway Minister Lalu Yadav on Friday announced fare cut in AC and mail express trains by 2%. He also announced the introduction of 43 new trains and kept freight rates unchanged. ( Watch )
Railways would introduce wagons with higher capacity. Railways to spend Rs 23,000 crore in 2009-10.

He presented an interim budget this time as elections are due soon and by convention the presentation of the regular budget in an election year is left to a new government.

The regular rail budget presented last year reduced fares across the board besides focusing on hygiene, punctuality, new routes, better coaches and mobile ticketing.

Deemed Sale ?

Under the State Sales Tax Laws, before the 46 th Amendment to the Constitution of India, the Sales Tax was applicable only on the sales covered under the sale of goods Act (Normal sale). The indivisible works contracts were not covered under the State Sales tax Acts since works contracts were not normal sales. The Supreme Court confirmed this legal status in its land mark judgment in the case of Gammon & Dunkerely (9 STC 353). Due to this legal status, the states were denied the levy of Sales Tax on the indivisible works contracts. Such contractors were outside the clutches of sales tax laws.

The then Finance Ministers of the States have requested the then Union Finance Minister to take necessary legal steps so as to levy Sales Tax on indivisible works contracts.

Finally, the 46 th amendment to the Constitution of India has been made on 2 nd February, 1983 to add a sub-article (29-4) as under,

“(b) a tax on the transfer of property in goods (whether a goods or in some other form) involved in the execution of a works contract”.

After the said 46 th Amendment to the Constitution, the States were empowered to levy Sales Tax / Works Contract Tax on such sales, called as “Deemed sales” involved in the execution of works contract. Due to the said amendment, the concept of `Deemed Sale’ was introduced. The important features of deemed sales are as under,

(a) It is not a normal sale as defined under sale of goods Act but a deemed sale of goods subject to sales tax by the States.

(b) In the `deemed sales’ the states can levy Sales tax only on `the transfer of property in goods” . In other words , the states can levy Sales Tax / VAT only on the `Material Value’ of the works contract and not on the `labour portion’ of the works contract.

( c ) If in a contract there is no transfer of property in goods from the contractor to the contractee, then No sales tax is applicable on such contracts, called as “ Pure Labour Jobs”.

(d) Under the deemed Sale , an artificial break up of indivisible works contract has to be made to arrive at the `material’ value and the `labour’ value of the contract.

Therefore, after the 46 th Amendment to the Constitution of India, the States are empowered to levy sales tax (now VAT) on such deemed sales but only on the `Material Value’ of the works contract. The High Courts and the Supreme Court have suggested methods on “How to arrive at a material value from the total Contract Price”. (Gannon Dunkerly’s SC Judgement 1993 ) (88 STC 204).

The Supreme Court has also allowed the States to come out with an alternative method to levy Sales Tax on Works contract, if to arrive at material value is difficult. The states have come out with a alternative method called as “Composition Tax” method to tax the indivisible works contract, which is a non-legal /alternative method. The small percentage like 1%, 2%, 4%, 8% as Composition Tax is levied but on the total contract price without any deduction which is available in the legal options under the State Sales Tax / VAT Acts. After, the said amendment to the Constitution certain States a namely Maharashtra & Delhi have come out with separate `Works Contract’ Acts. The other states incorporated the separate provision to levy Sales Tax on the deemed sales in the works contracts. Under the State Sales Tax Acts or separate Works Contract Acts, No contractor or contractee were entitled to claim any set off of Sales Tax paid to their vendors. There was a double taxation in the hands of Contractors in the Sales Tax Regime.

-( Difference between Normal Sale & Works Contract )

The works contracts are not normal sales. In the normal sale there is a transfer of property in definite or ascertained goods. The goods remain same before and after the delivery of the goods. However, in works contracts it does not happen. The goods before the delivery and after the execution of works contracts are different, many times in different form also. For example, at the site of construction of a building, before the Construction (works contract) commences, the goods like cement, steel, sand etc. are lying but after the Construction a building (immovable goods) comes to an existence. This is the difference between the ` Normal” sale and the “deemed sale” in the indivisible works contract .

The Supreme Court of India, in its various landmark judgments has confirmed in the following wordings the difference between a normal sale (as defined under the sale of goods Act) and an indivisible / composite works contract;

“In a contract of sale, the main object is the transfer of Property and delivery of the possession of Chattel as a Chattel to the buyer, where it is not so, it is a contract of Works & Labour” (Hindustan Aeronautics Ltd. 55-STC 314-SC).

“If the thing to be delivered has any individual existence before the delivery as the property of the party who is to deliver it, then it is a sale. If the main object of the work undertaken is not the transfer of a Chattel qua Chattel, the contract is one for work and labour” (Hindustan Shipyard – 119 STC 533-SC).

“The activity is a sale or works contract depends upon the facts, the terms and conditions and the intention of the parties” (Mekenzis Ltd.-165 STC-58 SC)

In normal practice, we can identify many indivisible/composite works contracts namely construction of a Building, erection of Plant & Machinery, Processing jobs, Job works, Repair jobs, Electrical Fittings, Annual maintenance Contracts (AMCs). Installation of Elevators, Air Conditioners, Repairs of Vehicles, Re-trending of old tyres, Customized Printing Jobs, Electro Plating, electro-galvanizing, anodizing etc. We would discuss later , the levy of Sales Tax/VAT on such activities which are indivisible works contracts.

1. Eligibility:
a) For Deputed Candidates: Bachelor’s Degree in any subject with at least one
year’s experience (as on the last date for submission of applications) as a wholetime
salaried employee in a recognized library/information center. The
application must be forwarded with a ‘No Objection’ certificate by the
Appointing Authority.
b) For Certificate in Library Science holders: Bachelor’s Degree in any subject plus
Certificate in Library & Information Science with minimum 60% marks (45% for
SC/ST and 55% for PD candidates) from any recognized institution.
c) For others: An Honours and/or Master’s Degree in any subject or equivalent
degree with a minimum of 50% marks at any level (no marks barrier for
SC/ST/PD candidates) from any recognized institution, with a minimum of 45%
marks in the H.S. or equivalent examination.
2. Applicants are requested also to read the instructions given in the prescribed application
form. Applications submitted or received by post after the notified last date will not be
considered.
3. For candidates under the SC/ST Quota: Scheduled Caste and Scheduled Tribe certificate
must be obtained from a competent authority in the name of the candidates themselves.
An attested photocopy of the certificate must be furnished along with the application
form.

THE RYOICHI SASAKAWA YOUNG LEADERS FELLOWSHIP FUND PROGRAMME SYLFF

Jawaharlal Nehru University received the prestigious SYLFF endowment fund in June 2003. JNU and Jadavpur University are the only two institutions of higher learning in India to receive this grant. As of March 2007 there were 69 SYLFF endowed institutions in 45 countries, including JNU.

The SYLFF Program is a collaborative effort of the Nippon Foundation and the Tokyo Foundation. While the Nippon Foundation provides the grants for the successful running of the fellowship programme, the Tokyo foundation is responsible for the administration of the fund.

Out of the grant of US$ 1 million to Jawaharlal Nehru University, by the Nippon Foundation, two fellowships are awarded every year after calling for application from interested candidates of School of Social Sciences, School of Arts and Aesthetics, School of International Studies, School of Language, Literature and Culture Studies, Center for the Study of law and Governance, Special Center for Sanskrit Studies. The university has formed a Steering Committee for SYLFF to administer the fellowship. On behalf of screening committee Vice-Chancellor constituted a separate screening committee to interview the applicants and recommending the award of fellowship. The Steering Committee approves the recommendation and confers the fellowship. The fellowship holders enjoy the fellowship for a period of 3 years at the rate of Rs.15000/- per month. Depending upon the availability of interests, at any given time there could be six or seven fellowship holders.

Dr. S Chandrasekaran is SYLFF administrator in the University, who is also the Coordinator [Evaluation], also a member of the steering committee and often works as mediator between Tokyo foundation, AJSF and the University administration.

Keeping to the spirit of SYLFF programme to nurture future leaders, who shall transcend all barriers and shall be catalysts in bringing world peace and well being of humankind JNU has selected fellows in all successive years. The first batch of SYLFF Fellowship was granted to Mr. Dhrub Kumar Singh and Mr. Bikramaditya Kumar Choudhury. The second batch of fellowship was granted to Mr. Kamei Aphun, Ms. Anindita Pujari and Ms. Sajitha M. The third batch of the fellowship was granted to Mr. N. Bijen Meetei , Mr. Saroj Ranjan Jha and Ms. Sunitha B Nair. The fourth batch of the fellowship is given to Mr. Dhiraj Kumar Nite and Ms Manisha Singh.

Management Entrance Test

Panjab University admission will be based on the basis of Management Entrance Test (MET) to be conducted by Panjab University on March 22, 2009 followed by Group discussion and personal interview. Test weightage 85%, Interview 7.5%, group discussion 7.5%

FEE STRUCTURE

1. The selected candidates will have to deposit Rs 2,00,000 (Rs. Two Lakhs only) by DD in favour of Registrar,
Panjab University, Chandigarh, payable at Chandigarh as tuition fee per year. In addition, other university charges
will be levied.
Further, the candidates will have to deposit another Rs. 10,000/- by DD in favour of Director, UIAMS, Panjab
University, Chandigarh, payable at Chandigarh towards, Summer Placement, Teaching Materials, Business Club
and Computer Charges etc.
2. DETAILED INSTRUCTIONS with respect to fee, refund of fees, documents and procedures will be sent to the
selected candidates before counselling. The Board of Control of UIAMS has the final authority regarding admissions
and changes can be made in the existing rules, according to the University rules prevailing in 2009 as given in the
‘Handbook of Information and Rules for admission’ of the University.

* In case of two or more applicants obtaining equal marks, inter-se merit of such applicants shall be determined by marks obtained in Mathematics/Biology and then in Physics in NEAT-2009 and then by age (preference shall be given to older applicants).
